Welcome to VitaliT, a health and wellness mobile application operated by Good Vibes Pty, Ltd. headquartered in Australia (“VitaliT,” “we,” “us,” or “our”).

These Terms and Conditions (“Terms”) govern your use of the VitaliT mobile application, website, and related services (collectively, the “Service”).

By downloading, accessing, or using VitaliT, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, subscribing, or otherwise using VitaliT, you confirm that:

You are at least 16 years old (or the legal age of consent in your jurisdiction).
You have the legal capacity to enter into a binding agreement.
You will use the Service in compliance with these Terms and applicable laws.

If you are accessing the Service on behalf of another person or entity, you confirm that you have authority to bind that person or entity.

VitaliT provides wellness, fitness, and lifestyle information for educational and motivational purposes only. It is not a substitute for medical advice, diagnosis, or treatment.

Always consult your doctor or a qualified healthcare provider before:

Starting any new exercise program, nutrition plan, or supplement regimen.
Making changes to your physical activity, diet, or medication.

By using VitaliT, you acknowledge and agree that:

Participation in physical activities involves inherent risks of injury or harm.
VitaliT is not responsible for any injuries, health issues, or results arising from your use of the Service.
You are solely responsible for assessing your physical condition and determining whether the workouts or wellness plans are appropriate for you.

If you experience pain, dizziness, or discomfort, stop immediately and seek medical attention.

3. Account Registration

To access certain features, you may need to create a VitaliT account. You agree to:

Provide accurate and complete information during registration.
Keep your login credentials secure and confidential.
Be responsible for all activity occurring under your account.

We have the authority to suspend or terminate accounts that breach these Terms, engage in fraudulent activities, or jeopardise the security or integrity of the Service.

4. The Service

VitaliT offers digital programs focused on fitness, mobility, mindfulness, and wellness. Features may include:

Guided workout videos
Wellness challenges and meal plans
Progress tracking tools
Access to exclusive content
Notifications and reminders

We may update, modify, or remove features from time to time to improve your experience.

We do not guarantee that the Service will always be available, uninterrupted, or error-free.

5. Coaching and Guidance Content

VitaliT’s programs and guidance are created by certified professionals and designed for general use. They are not tailored to individual medical needs and should not replace professional advice from your healthcare provider.

All exercise demonstrations, wellness content, and meditation guidance are provided “as is.” Use at your own discretion and risk.

6. Third-Party Services and App Stores

VitaliT may contain links to third-party websites, tools, or services that we do not own or control.
We are not responsible for the content, privacy practices, or terms of such third parties.

Your purchase and access to VitaliT through app stores (Apple App Store or Google Play) are also governed by the respective store’s terms of service.

App store providers are not responsible for providing maintenance, support, or refunds beyond their stated policies.

7. Subscription Fees and Payment

Certain features of VitaliT are available through a paid subscription (“Subscription”). When you subscribe, you authorize the app store or payment provider to charge the applicable fee to your chosen payment method.

Auto-Renewal:
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
Your payment method will be charged for the next billing cycle unless you cancel beforehand.

Cancellation:
To cancel, follow the instructions for your platform:

Apple App Store: Manage subscriptions in your Apple ID settings.
Google Play Store: Manage subscriptions in Google Play > Payments & Subscriptions.
Deleting the app does not cancel your subscription.

After cancellation, you will continue to have access until the end of your current billing period.

Refunds:
All payments are non-refundable except where required by law.
Refund requests for purchases made through the App Store or Google Play must be directed to those platforms.

8. User-Generated Content

If you post or submit any content (for example, progress notes, comments, or testimonials), you grant VitaliT a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content for legitimate business purposes (such as improving the Service or promoting user success stories).

You represent that:

You own or have permission to use any content you share.
Your content does not infringe the rights of others or violate any laws.

We may remove user content that is offensive, illegal, or violates these Terms.

9. User Responsibilities and Restrictions

You agree not to:

Use VitaliT for unlawful, fraudulent, or harmful purposes.
Copy, modify, or distribute our content without written permission.
Circumvent security or subscription restrictions.
Use the Service in a way that could damage, disable, or overload our systems.
Post content that is defamatory, harassing, discriminatory, or otherwise inappropriate.

We reserve the right to suspend or terminate access to users who violate these terms.

10. Intellectual Property

All content within VitaliT App, including text, images, videos, designs, trademarks, and logos, is owned by VitaliT or its licensors.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

You may not reproduce, distribute, publicly display, or create derivative works without our prior written consent.

11. Disclaimers of Warranties

VitaliT is provided on an “as is” and “as available” basis.
We make no representations or warranties regarding:

The accuracy or reliability of content
The results you may achieve
The uninterrupted or error-free operation of the Service

To the fullest extent permitted by law, VitaliT disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, VitaliT, its affiliates, and team members shall not be liable for any indirect, incidental, consequential, or special damages, including injury, loss of data, profits, or goodwill, arising from your use of VitaliT.

Our total liability for any claim shall not exceed the amount you paid (if any) for access to the Service during the 12-month period preceding the claim.

13. Indemnity

You agree to indemnify and hold harmless VitaliT, its affiliates, and employees from any claim, loss, damage, or expense (including legal fees) arising from:

Your breach of these Terms
Your misuse of the Service
Your violation of any law or third-party rights

14. International Use

VitaliT is accessible globally. You are responsible for complying with local laws when accessing or using the Service outside Australia.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed under the laws of Australia. Any disputes arising under or in connection with these Terms shall be resolved by the competent courts of New South Wales, Australia.

If you are located outside Australia, you agree that Australian law applies, without regard to conflict of law principles.

16. Termination

We may suspend or terminate your access to VitaliT if:

You breach these Terms or applicable laws
We suspect fraudulent or harmful activity
We discontinue the Service

Upon termination, your right to use VitaliT ends immediately. Sections related to intellectual property, disclaimers, limitation of liability, and governing law will survive termination.

17. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we’ll notify you via email, app notification, or website post before the new terms take effect.

Continued use of VitaliT after such notice constitutes acceptance of the updated Terms.
